PRINCIPLES RELATING TO THE PROCESSING OF PERSONAL DATA

The Regulation establishes the rules relating to the protection of individuals with regard to the processing of personal data and the rules relating to the free circulation of personal data. It protects the fundamental rights and freedoms of individuals and in particular their right to the protection of personal data. Your personal data are collected only to an extent compatible with the purposes described in the following paragraph and their treatment will be based on principles of correctness, lawfulness and transparency.

PURPOSE OF THE PROCESSING AND RELATED LEGAL BASES

Your personal information (which may also include details and judicial data), may be used for the following purposes:

a) research and staff recruitment: on their own behalf and for its own account;
b) assessment of the profiles and professional skills and their updating, definition of individual development plans and career, performance evaluation, participation in training and refresher courses, both in Italy and abroad;
c) out-of-court or judicial dispute management;

Might happen that during the selection phase, the Data Controller collects and processes special categories of data, in particular data showing the membership of the involved party to a protected category. For these processing activities, we remind you that consent is required by the Regulation.

If the Company intends to use the personal data collected for any other purpose incompatible with the purposes for which the personal data were originally collected or authorized, the Company will inform the interested party in advance.
Your data will be processed directly by Bruschi Srl or by third parties providing services specifically designated as Data Processors.
The legal basis consists in the execution of pre-contractual measures adopted at the request of the interested party and / or to fulfill the obligations and exercise the specific rights of the owner or of the interested party regarding labor law .

PROCESSING METHOD

The data are processed by the Data Controller or by the Data Processors in accordance with articles 4-6 of the GDPR, both manually (processing of documents and paper documents) and by means of IT methods and procedures, also with the aid of electronic means, telephone, telematic or automated means, including automated calling systems, fax, e-mail, SMS or MMS messages or other, solely for the purpose of pursuing the purposes for which they were collected; the same methods and procedures are also used when the data are communicated - in Italy or abroad - for the above purposes and to various person who in turn are committed to processing them using only the methods and procedures strictly necessary for the specific purposes indicated in this notice and in accordance with the law.

In carrying out its processing activities, the Company undertakes to:

  • guarantee the accuracy and updating of the processed data, and promptly acknowledge any corrections and / or additions requested by the interested party;
  • take security measures to ensure adequate data protection, taking into account the potential impact of the processing on respect for the fundamental rights and freedoms of the data subject;
  • communicate to the interested party, within the times and cases provided for by law, any violations of personal data;
  • ensure that the processing operations comply with the applicable legal provisions.

SCOPE OF CIRCULATION AND DISCLOSURE OF PERSONAL DATA

Bruschi Srl employees who need it for the performance of their duties or by virtue of the position they hold, or other subjects who provide services to Bruschi Srl and who have been specifically designated as Data Processors, may have access to your data.
Your data may also be disclosed:

  • within Bruschi Srl, in departments or offices in Italy or abroad, including countries outside the European Union, where the company Bruschi Srl operates;
  • to consultants and / or freelancers in order to receive opinions on the application of the labor law regulations for employment contracts, as well as for activities aimed at the correct implementation of the employment relationship; to law firms for the management of disputes;
  • to professionals or service companies that offer the management, including IT, of documents and workflows.

TRANSFERS OF DATA ABROAD

As part of the purposes described in this statement, the Company may also transmit the data you provide to countries outside the European Union such as, for example, the United States. Any transfer of the data of the interested party to countries located outside the European Union will take place, in any case, in compliance with the appropriate and necessary guarantees for the purposes of the transfer itself pursuant to the applicable legislation and in particular, to the articles 45, 46 and 47 of the Regulation. The party involved has the right to obtain a copy of the data held abroad and to get information about the place where they were held upon written request to the Data Controller to use the methods described in the section "Contacts" of this policy.

RETENTION PERIOD

Except in case of recruitment, the Data Controller will carry out a review, after twenty-four months from the date of registration in order to verify whether the data should continue to be processed or be deleted. Even before this deadline, if you deem the purpose of the processing to be exhausted, you can give written notice to the Data Controller who will immediately proceed with the cancellation of your personal data.
In cases where a temporary employment contract is finalized, Bruschi Srl, after the conclusion of the employment relationship, may keep and use the information concerning you in a way that allows your identification for a period of time not higher than the achievement of the purposes for which they are processed or for personnel management purposes and for the fulfillment of legal and contractual obligations.

EXERCISE OF RIGHTS

According to the Regulations (Arts. 15-22), the interested party may exercise towards the Data Controller the following rights:
Right of Access: The interested party has the right to access personal data concerning him that are being processed in order to verify whether his personal data are treated in accordance with the law.
Right of Rectification: The interested party has the right to obtain the rectification of any inaccurate or incomplete information about himself, in order to guarantee the accuracy of such information based on the purposes of the processing.
Right to Erasure: The interested party has the right to request that the data holder erase his information and that he no longer processes such data.
The Right to Restriction of Processing: The interested party has the right to request that the holder of the data limits the processing of his data.
Right to Data Portability: The interested party has the right to receive personal data in a structured, commonly used and machine-readable format and to transmit such data to another data controller.
Right to Object to Processing: The interested party has the right to object to the processing of data in the cases provided for by the GDPR, at any time and without having to justify their decision.
Right not to be subject to Automated Decision-making Processes: The interested party has the right not to be subjected to a decision based exclusively on an automated processing of his data, including profiling, which produces legal effects on him or which affects similarly significantly on his person.

If the processing is based on consent, pursuant to art. 7 of EU Regulation 2016/679, the interested party can revoke the consent given at any time, without prejudice to the lawfulness of the processing carried out before the revocation.
